Hannah Payne, who faces malice murder and other charges in the 2019 shooting of Kenneth Herring during a traffic dispute, is set to go on trial January 23, 2023.

Superior Court Judge Shana Rooks Malone ordered a specially set trial date after she said Payne’s defense attorney, Matt Tucker, failed to notify the court that he had suffered a stroke two days before jury selection was to have started.

Malone declared Tucker in contempt of court and said she would file a complaint with the State Bar of Georgia. Tucker had previously been half an hour late to a motions hearing.
